{"id":1410,"date":"2014-05-01T07:28:38","date_gmt":"2014-04-30T23:28:38","guid":{"rendered":"http:\/\/localhost\/portal\/2014\/05\/01\/microsoft-privacy\/"},"modified":"2014-05-01T07:28:38","modified_gmt":"2014-04-30T23:28:38","slug":"microsoft-privacy","status":"publish","type":"post","link":"https:\/\/www.cyberhunter.com.tw\/?p=1410","title":{"rendered":"Microsoft &#8216;must release&#8217; data held on Dublin server"},"content":{"rendered":"<p><a href=\"http:\/\/www.bbc.com\/news\/technology-27191500\" target=\"_blank\" rel=\"noopener\">BBC News<\/a>&nbsp;&nbsp;29 April 2014 Last updated at 09:18<\/p>\n<p>&nbsp;Internet companies will have to hand over users&#8217; data even if it is held abroad, a judge has ruled&nbsp;<\/p>\n<div>\n<img decoding=\"async\" src=\"http:\/\/news.bbcimg.co.uk\/media\/images\/74499000\/jpg\/_74499140_pen.jpg\" alt=\"\" \/><br \/>\n&nbsp;<\/div>\n<div>A judge in the US has ordered Microsoft to hand over a customer&#8217;s emails, even though the data is held in Ireland.<\/div>\n<div>&nbsp;<\/div>\n<div>The company had attempted to challenge the search warrant on the basis that the information was stored exclusively on computer servers outside the US.&nbsp;<\/div>\n<div>&nbsp;<\/div>\n<div>Microsoft previously said it planned to offer business and government clients control over where their data resided.<\/div>\n<div>&nbsp;<\/div>\n<div>This followed concerns about data privacy raised by whistleblower Edward Snowden&#8217;s leaks about US spying.<\/div>\n<div>&nbsp;<\/div>\n<div>But the ruling potentially undermines that pledge.<\/div>\n<div>&nbsp;<\/div>\n<div>The judge said warrants for online data were different to other warrants.<\/div>\n<div>&nbsp;<\/div>\n<div>The search warrant, which was issued to Microsoft by US authorities, sought information associated with a member of the public&#8217;s email account including their name, credit card details and contents of all messages.<\/div>\n<div>&nbsp;<\/div>\n<div>Microsoft said it would continue to oppose the release of the Dublin-stored data.<\/div>\n<div>&nbsp;<\/div>\n<div>&quot;This is the first step toward getting this issue in front of courts that have the authority to correct the government&#8217;s longstanding views on the application of search warrants to content stored digitally outside the United States,&quot; it said.<\/div>\n<div>&nbsp;<\/div>\n<div>&#8216;Government disagrees&#8217;<\/div>\n<div>&nbsp;<\/div>\n<div>Judge James Francis in New York said that this was true for &quot;traditional&quot; warrants but not for those seeking online content, which are governed by federal law under the Stored Communications Act.&nbsp;<\/div>\n<div>&nbsp;<\/div>\n<div>He said the warrant should be treated more like a subpoena for documents.
